These Terms of Service ("Terms") govern your access to and use of the website serraphea.com (the "Site"), as well as any order of products placed through this Site.
The Site is operated by Serraphea Limited, registered under company number 78544783, with its registered office at Office 3906, 39th The CTR 99, Queen's Road Central, Central, Hong Kong ("Serraphea", "we", "us", "our").
By placing an order, you accept these Terms in full. Please read them carefully before completing your purchase.
Article 1 — Use of the Site and Eligibility
You declare that you are at least 18 years old and have the legal capacity to enter into a contract. If you are a minor, you must obtain prior consent from a parent or legal guardian.
Use of the Site is subject to these Terms. You agree to use the Site and our products in accordance with applicable law and for their intended purposes. Any violation may result in suspension of your access.
Article 2 — Hosting and Platform
Our online shop is hosted by Shopify Inc., which provides us with the e-commerce platform enabling us to sell our products.
Article 3 — Products and Prices
Product descriptions. We make every effort to describe our products accurately (composition, dimensions, photographs). Under UK consumer law, these descriptions form part of our offer and bind us. Slight variations in colour display may occur depending on screen settings.
Prices. Prices are shown in pounds sterling (GBP), inclusive of any applicable VAT, exclusive of delivery costs. Delivery costs are shown separately before checkout.
We reserve the right to change prices at any time. Any price change applies only to future orders; orders already validated are fulfilled at the price in effect at the time of validation.
Availability. Our products are offered subject to availability. If a product becomes unavailable after your order is validated, we will inform you promptly and refund in full the sums paid for that product.

Formation of the contract. The contract of sale is formed at the moment we send you the dispatch confirmation email. Before this point, we reserve the right to refuse or cancel an order for legitimate reasons, including:

Reasonable suspicion of fraud

Obvious error in price or product description

Quantities ordered that are clearly unusual (commercial orders not identified as such)

History of unpaid orders

Product unavailability
In such cases, we will refund in full any payment already made.
Article 5 — Payment
Payment is made at the time of ordering through the payment methods offered on the Site (credit/debit cards, PayPal, etc.). Payment data is processed securely by our payment providers and is never retained by us.
Article 6 — Delivery
The terms, timeframes, and costs of delivery are set out in our Shipping Policy, which forms an integral part of these Terms.
Article 7 — Right to Cancel and Returns
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a statutory right to cancel within 14 days of receiving your order. The terms of exercise of this right, together with our extended commercial return policy, are set out in our Returns and Refund Policy, which forms an integral part of these Terms.
Article 8 — Statutory Rights Under the Consumer Rights Act 2015
All products supplied are subject to the protections of the Consumer Rights Act 2015: they must be of satisfactory quality, fit for purpose, and as described.
In particular, you benefit from:

The short-term right to reject faulty goods within 30 days of delivery for a full refund;

The right to repair or replacement after 30 days;

The right to a price reduction or final rejection if repair or replacement fails;

A period of up to 6 years to bring a claim (5 years in Scotland) if you can show the fault was present at delivery.

Article 9 — Customer Account
Creating a customer account is optional. You agree to provide accurate information and keep it up to date. You are responsible for the confidentiality of your login credentials.
We may suspend or delete an account in case of serious violation of these Terms, after notifying you, except in cases of urgency (fraud, security).
Article 10 — Intellectual Property
All elements of the Site (text, images, trade marks, logos, design) are protected by copyright and intellectual property rights. Any reproduction, representation, or exploitation, in whole or in part, without our prior written authorisation, is prohibited.
Article 11 — User Content
If you submit reviews, suggestions, photographs, or comments (for example, through a product review), you grant us a non-exclusive, royalty-free, worldwide licence to use such content for purposes of communication relating to our products (publication on the Site, social media, commercial communications), in compliance with the author's moral rights.
You warrant that you hold the necessary rights to such content and that it does not infringe the rights of third parties.
Article 12 — Personal Data
The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms and is accessible at any time on the Site.
Article 13 — Prohibited Uses
It is forbidden to use the Site for:

Any illegal or fraudulent activity;

Infringement of third-party rights (copyright, trade marks, privacy);

Transmission of viruses, malware, or destructive code;

Collecting other users' personal data without their consent;

Sending spam or unsolicited communications;

In case of breach, we reserve the right to suspend access to the Site and to take any appropriate legal action.
Article 14 — Links to Third-Party Sites
Our Site may contain links to third-party sites. These links are provided for information; we do not control their content and cannot be held responsible for the information, products, or services they offer.
Article 15 — Liability
We commit to providing a Site and products that comply with their description and applicable law.
We remain fully liable in the cases provided for by law, including:

For the statutory rights granted to consumers under the Consumer Rights Act 2015;

For personal injury caused by a defect in our products;

In case of fraud or gross negligence;

More generally, in all cases where the law prohibits the exclusion or limitation of liability towards consumers.
To the extent permitted by law, our liability for indirect losses (loss of profits, loss of opportunity, etc.) arising from use of the Site is excluded, save for the cases mentioned above.
The Site is provided "as is". While we make every effort to ensure its availability, we do not guarantee that it will operate without interruption or error.
Article 16 — Force Majeure
Neither party will be liable for non-performance of its obligations in cases of force majeure as defined under English law (natural disasters, pandemics, large-scale strikes, governmental restrictions, etc.).
Article 17 — Complaints and Dispute Resolution
For any complaint, please contact us first at support@serraphea.com. We commit to responding promptly and seeking an amicable solution.
If we are unable to resolve the dispute directly, you may obtain free impartial advice from the Citizens Advice consumer service (https://www.citizensadvice.org.uk/consumer) or pursue your claim through the small claims track of the County Court (or Sheriff Court in Scotland).
We are not currently signed up to any specific Alternative Dispute Resolution (ADR) scheme.
Article 18 — Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales.
As a consumer, you retain the benefit of any mandatory consumer protection rules of your country of residence within the United Kingdom (England and Wales, Scotland, or Northern Ireland), where these offer protection beyond what is set out here.
In case of dispute, you may bring proceedings before the courts of your place of residence or the courts of England and Wales, at your choice.
Article 19 — Severability
If any provision of these Terms is held to be invalid, unlawful, or unenforceable by a competent court, that provision shall be deemed not written, without affecting the validity of the other provisions, which shall remain in force.
Article 20 — Modifications to the Terms
We reserve the right to modify these Terms at any time. The Terms applicable to your order are those in effect at the time of validation. The latest version is always available on this page, with the update date shown at the top.
Article 21 — Entire Agreement
These Terms, together with the Returns and Refund Policy, the Shipping Policy, and the Privacy Policy, constitute the entire agreement between you and Serraphea Limited. In case of inconsistency between these documents, these Terms prevail, save for mandatory legal provisions.
Article 22 — Language
These Terms are drafted in English. Any translation provided is for information purposes; the English version prevails.
